Content:
All services provided by WebAngel Pty. Ltd.. may be used
for lawful purposes only. Transmission, storage, or presentation
of any information, data or material in violation of any
Federal or State law is prohibited. This includes, but
is not limited to: copyrighted material, material we judge
to be threatening or obscene or material protected by trade
secret and other statute, and invasion of privacy.
All pornographic content and sex-related merchandising
is prohibited on all WebAngel Pty. Ltd. servers. This includes
sites that may infer sexual content or links to adult content
elsewhere. WebAngel Pty. Ltd. will be the sole arbiter
in determining violations of this provision.
Also prohibited are sites that promote any illegal activity
or present content that may be damaging to WebAngel Pty.
Ltd. servers or any other server on the Internet. Links
to such materials are also prohibited.
Examples of unacceptable content or links:
- Pirated software
- Hacker programs or archives
- Warez sites
WebAngel Pty. Ltd.. will be the sole arbiter as to what
constitutes a violation of this provision.
Indemnification
You agree to indemnify, defend, and hold WebAngel harmless
against any and all liability, penalties, losses, damages,
costs, expenses, legal fees, causes of action or claims
caused by or resulting indirectly from your use of the
service which damages either you, or any other party or
parties without limitation or exception.
This extends to all issues associated with your account,
including but not limited to domain name selection and
Web site content.
Support for Third Party Programs
A number of programs (eg Shopping carts, email, statistics,
etc) are provided in your hosting control panel.
Current information about them is available from their developers, who
usually provide documentation and support forums.
Please note that WebAngel does not provide support services for these
programs.
Unsolicited Commercial Email - (SPAM)
Sending unsolicited e-mail, (commonly known as spam)
is prohibited from our systems. Any user who sends
out obvious spam messages will have their account terminated
without notice. However, in cases where it appears that
you may have been improperly accused of spamming, we
will contact you for an explanation.
Please be aware that sending out messages to email addresses
from CD's you have purchased on the internet will virtually
guarantee that your account will be cancelled. Don't believe
the claims of people who try to sell you these CD's which
often contain millions of email addresses. These will have
been "harvested" without people's knowledge from
websites, chat rooms, and forums.
Sites that promote, sell, or otherwise provide access
to spamware products or products that are solely for the
purpose of extraction or sale of email addresses or which
are used to send bulk email are not permitted on any WebAngel
server.
Misuse of System Resources:
Any attempt to cause harm to a server, or customer, of
WebAngel Pty. Ltd. is strictly prohibited, and will be
grounds for immediate account cancellation. This includes,
but is not limited to the following:
- using programs that consume excessive CPU time;
- allowing the use of mail services, mail forwarding
capabilities, or autoresponders other than for the customer's
own account;
- unauthorised resale of disk space to others;
- use of servers for backup of files unrelated to the
web site of the account;
- CGI or PHP shell scripts are not permitted, and will
be deleted when discovered.
- Web Proxy scripts are not permitted,and will be deleted
when discovered.
No IRC related software is permitted on our servers. This
includes servers, bots, bouncers, or any other software
that is used for the purpose of creating, maintaining,
or providing access to IRC servers or channels. Accounts
that are found to have such software uploaded to their
web space are subject to immediate suspension and/or termination
without notice.
You agree that WebAngel has the right to monitor the data
passing through our systems from time to time and to disclose
any information as necessary to satisfy the law, or to
protect itself or its subscribers.
Account Policies.
Accounts are payable in full at the time the account is
created.
If you are under 18 years of age, you need to have parental
consent in order to have an account created, and the account
must be ordered in the name of a parent or guardian.
We require a current and truthful name, postal address
and telephone number for our records, and you have a continued
obligation to keep this information current. The easiest
way to do this on our online billing system. Access details
will be provided on signup.
You also agree that you are an authorized user of any
credit card that you supply to us, and you understand that
we will co-operate fully with authorities in the case of
any misuse of credit cards.
Payment for WebAngel hosting services is required in advance.
Your card will be billed on a recurring basis unless you
notify WebAngel of your desire to cancel these services.
If payment is not received with 7 days of the due date,
your account will be suspended. If this occurs, your website
and email services will become unavailable.
After account suspension, payment of
all arrears plus a fee of $25
(plus
GST) is
required before the account is restored.
Suspension and Cancellation:
If you do something which results in a suspension or deactivation
of your account, all fees paid will be forfeited. In addition,
you will be liable for the cost of rectifying any damage
that has been caused by your actions. A fee of $A25 (plus
GST) will apply to reactivation of an account that is suspended
for non payment of hosting fees.
You may cancel your account at any time. If cancellation
is made within the first 30 days of service all hosting
fees will be refunded. Fees for account setup and domain
registration are nonrefundable.
30 day guarantee
If you are not completely satisfied with our services
within 30 days of ordering a hosting account with us, you
will be given a full refund of the contract amount excluding
setup fees, excess bandwidth and disk space charges.
No refund is available after that period.
Accounts cancelled or terminated by WebAngel for violations
of our Acceptable Usage Policy do not qualify for the 30-day
money back guarantee.
No warranties
Our services is provided on an "as is" and "as
available" basis. Apart from the 30 day money back
guarantee, WebAngel makes no warranties or representations
of any kind for the services being offered.
We make every effort to have our servers operational at
all times. However, due to the nature of internet connections
your website and email may not be available from time to
time, even though our systems are operating perfectly.
Your use of the service is at your sole risk. WebAngel
is not responsible for files and data residing on your
account. You agree to take full responsibility for files
and data transferred and to maintain your own backups of
all files and data stored on WebAngel servers.
Agreement Acknowledgement
This agreement supersedes any written, electronic, or
oral communication you may have had with WebAngel or any
agent or representative thereof, and constitutes the complete
and total agreement between the parties.
In the event that any provision of this agreement is determined
to be invalid or unenforceable, all other provisions shall
remain in full force and effect and said provision shall
be reformed only to the extent necessary to make it enforceable.
WebAngel reserves the right to change this Usage Policy
at any time without prior notification.
By placing and continuing to maintain or place information
on WebAngel's servers you are stating and acknowledging
that you have read and understand these terms and conditions,
and agree to be bound by them.
Legal Jurisdiction
The laws of the State of Tasmania, Australia govern the
operations of WebAngel, and any claims are subject to the
laws of this state.
Refusal of Service:
We reserve the right to refuse, cancel, or suspend service
at our sole discretion.
All sub-networks, distributive hosting sites, and dedicated
servers of WebAngel Pty. Ltd.. must adhere to the above
policies. Please direct any reports of violations of the
above policies to abuse@webangel.com.au
Failure to follow any term or condition will be grounds
for immediate account deactivation.
